Bensalem, Pennsylvania - Law Offices of Howard G. Smith announces that it is investigating potential claims against certain current and former officers and directors of Community Health Systems, Inc. (“CHS” or the “Company”) (NYSE:CYH) related to allegedly improper Medicare billing and reimbursement practices.
The investigation concerns the allegations in a lawsuit filed by a former CHS employee that the Company’s senior officers and directors allegedly offered certain New Mexico counties an unrestricted "donation" each year with the understanding that the money would be used toward New Mexico's Sole Community Provider Fund and Sole Community Hospital Supplemental Payments program. The "donations" were then given back to CHS' hospitals - along with a federal government match at a three-to-one rate - in violation of federal Medicaid rules. CHS has been implicated in a similar scheme at the CHS-owned Helena Regional Medical Center in Arkansas, a hospital which CHS also operates. The investigation concerns possible breaches of fiduciary duty and other potential violations of state law related to these practices.
